If the pistol was seized, isn't it in the possession of Customs and thus he does not have any say in what to do with it?
My friend had a cheap springer pistol seized in the mail and he had no authority over it.
I mean there is the option of having it chronographed (which is pointless as I'm guessing it shoots under 366 fps) but aside from that I'm not sure what else you can do.
